I got hit with a design patent infringement claim on a design patent that seems to be complete BS but it is somehow registered and approved with the USPTO. The guy wants a lot of money to be able for me to sell his design and he's kinda got me by the balls because my business depends on it, though I could redesign in the future. I noticed some of my competitors are selling the exact same design...should I ask them if this guy reached out or no? Not sure what the cons are of asking? I'm curious if it's worth hiring a lawyer to fight this or just pay the guy because I have no chance of winning. My design does seem to infringe on his design patent, but his design patent is not unique at all.

  • [comment u/ProfitingFromUnknown] This shit is expensive. We spent 5k for nothing, the design was used first by us in the UK so they claim falsely.

  • “You don't need reddit you need a patent lawyer. But to be honest, getting a patent overturned, while entirely possible, is going to be time consuming and expensive. I'd still go find a lawyer and do an initial consultation.”

  • “Just curious, was the patent approved after you had already been selling your product?”

  • “Why? For your own curiosity? Or are you planning on replying “yeah well these people sell it, too!””

  • “This shit is expensive. We spent 5k for nothing, the design was used first by us in the UK so they claim falsely. In anyway, if its not exact replica, the design cases are all bullshit and expensive for both side”

  • “Damn sorry to hear this. Assuming they filled on Amaozn? I heard getting a lawyer ti write a letter might help you “win/defer the case on Amazon’s end and leave the patent holders only option to sue directly (expensive). Assuming Amaozn took down the listings right away? Do you see competitors up still?”
