I'm a Non-US resident and own a single-member Wyoming LLC formed on July 14, 2026. It has an EIN and is taxed as a default disregarded entity. Expected 2026 turnover is around $95,000. I run a digital services business remotely from my country, have no US office or employees, and use Stripe and Mercury. I also pay overseas freelancers. What US tax forms do I need to file for 2026 (Form 5472, pro forma 1120, 1040-NR, etc.)? Will I owe US federal income tax, and what Wyoming filings are required? Also, would buying USDT through the LLC to pay freelancers, create additional tax or reporting obligations? I'd appreciate advice from anyone experienced with foreign-owned US LLCs. Thanks!

  • “Hello, I think the key questions are where the services are performed, whether there's a US trade or business, and what transactions have taken place between the LLC and its foreign owner. The $95k turnover alone doesn't necessarily determine the tax position.”

  • “Yeah, Form 5472 and pro forma 1120 are going to be really important ones to file, and are required every year even if there wasn't any revenue, and the penalty for missing those is obscenely high at $25k. Federal income depends on whether the income qualifies as effectively connected to a US trade or business, and with no US office or employees and services performed outside the country, you could”

  • “Form 5472 and 1120-pro forma via e-fax, very likely. Buying USDT won't trigger taxation. Income from staking, though, is considered interest payment, which is FDAP income, so it's taxable.”

  • “dont miss the state filing, along with that form 5472 and form 1120”
