After doing a premium business audit Liberty mutual wants to charge me $6400… for last year, when I had no claims or issues. If I can’t get refunded for the insurance I paid for and didn’t use, why do they think they can retroactively charge me for an amount I did not agree to. Im not asking if I should pay this, I simply will not, I have a small construction company and I am stubborn, so if this LLC needs to get shut down and a new one created for the same company then that is what will happen, my question is, how can I civilly get out of this and if this gets sent to collections what happens then.

  • “The premium is determined based on the exposure. Probably payroll but could be something else. So if you took a policy out based on 40k total payroll but ultimately had 200k in payroll. You owe them the difference in premium. They provided coverage for the exposure”

  • “Most businesses policies say you are agreeing to be audited and truthful. So if you report you only have 10K in annual revenue but really had 100K, they can and will bill you for the difference in premium. Same goes for workers compensation and payroll. It’s a way to avoid insurance fraud. So you’re not under reporting to avoid paying the correct premium.”

  • “The premium is based on either your revenue or payroll depending on the exposure it was rated on, and while you might not have filed a claim, you absolutely used your insurance. Every certificate of insurance that was issued on your behalf that allowed you to generate revenue was you using your insurance.”

  • “This your first time having insurance on your business? This is common with every carrier we work with.”

  • “Not much you can do as you agree to the terms and conditions when you bound the coverage. Did your agent not make it clear that your policy was auditable? Your policy declarations page will also list that the policy is auditable as most construction classes are, so even if you go to another carrier that policy will also be auditable which is why it's important to give a sales/payroll estimate as c”
