Hello, I'm dealing with the payroll provider Gusto. They were supposed to enroll staff in their HSA on June 1st, 2026 and still haven't been able to enroll staff. They keep saying it's a backend technical issue with Elevate and don't have a timeline for resolving the issue. In the meantime we are looking for other payroll providers that is comparable in price. We are a non-profit of 6 FT staff and need HR, compliance, automated payroll, benefits and 401k. Any advice on getting Gusto to resolve the issue or switching providers? Are there legal and tax issues staff and the organization will have to deal with? If staff lost potential capital gains from HSA investment, who is responsible for compensation? We also are looking for non-profit lawyers.
